1. Introduction
These terms and conditions govern access to and use of the website, services, content, messaging features, listing tools, and related functionality provided by CustomClassifieds.cc, a classified motorcycle listings platform based in the United Kingdom.
By using the website, creating an account, browsing listings, contacting a Seller, or placing an advertisement, you agree to be bound by these terms. If you do not agree to these terms, you must not use the website.
2. Definitions
In these terms, unless the context requires otherwise:
- “Website”, “we”, “us” or “our” means uk.customclassifieds.cc, the operator of the classified listings platform.
- “User”, “you” or “your” means any person who accesses or uses the Website.
- “Advertiser” or “Seller” means a person, business, dealer, agent, broker, or representative who creates, publishes, manages, or is responsible for a motorcycle listing on the Website.
- “Buyer”, “Customer” or “Browser” means any person who searches, views, enquires about, negotiates for, or intends to purchase a motorcycle advertised on the Website.
- “Listing” means any advertisement, description, photograph, price, specification, claim, statement, message, document, or other information uploaded or supplied by a Seller in relation to a motorcycle.
- “Motorcycle” includes motorcycles, scooters, mopeds, custom motorcycles, project motorcycles, donor motorcycles, parts-built motorcycles, and any related vehicle or component advertised on the Website.
- “Transaction” means any sale, purchase, negotiation, viewing, inspection, deposit, payment, collection, delivery, or other arrangement between a Seller and a Buyer.
3. Our Role as a Classified Listings Platform
The Website provides an online classified advertising service that enables Sellers to advertise motorcycles and enables Buyers to browse listings and contact Sellers. Unless expressly stated otherwise, we are not the Seller, Buyer, owner, dealer, agent, broker, valuer, inspector, insurer, mechanic, or finance provider in any Transaction.
Any contract for the sale or purchase of a motorcycle is made directly between the Seller and the Buyer. We do not guarantee the existence, ownership, condition, roadworthiness, provenance, legality, accuracy, value, availability, or suitability of any motorcycle or Listing.
4. Seller Responsibilities
Each Seller is solely responsible for every Listing they submit, publish, amend, renew, or authorise. By placing a Listing, the Seller confirms that all information supplied is accurate, complete, lawful, and made in good faith.
The Seller must only list a motorcycle that they own or that they have the owner’s explicit written permission to sell on the owner’s behalf. The Seller must be able to provide evidence of ownership, authority, identity, and any relevant documentation if reasonably requested by a Buyer, us, a payment provider, law enforcement, Trading Standards, or another competent authority.
The Seller is responsible for ensuring that any claims about the motorcycle’s provenance, history, mileage, registration status, previous keepers, parts, work carried out, fabrication, design, modifications, customisation, restoration, donor bike, build quality, originality, authenticity, service history, MOT status, or roadworthiness are truthful, clear, not misleading, and supported by appropriate evidence where such evidence exists.
Unless clearly and prominently stated in the Listing before any viewing, deposit, payment, or sale, the Seller must only offer for sale motorcycles that are safe to ride and mechanically safe for their advertised purpose. The Seller accepts full responsibility for the mechanical safety, description, disclosure, and legal saleability of the motorcycle they advertise or sell.
The Seller must clearly disclose any known insurance write-off category, structural damage, accident history, salvage status, stolen/recovered status, identity issue, outstanding finance, import status, registration irregularity, or other material fact that may affect the motorcycle’s safety, value, legality, insurability, or desirability. This includes any write-off category affecting a custom motorcycle, donor motorcycle, frame, engine, or other significant component used in a build.
The Seller must not advertise stolen motorcycles, cloned motorcycles, motorcycles subject to undisclosed finance or third-party rights, motorcycles with false identity documents, or motorcycles that cannot lawfully be sold in the United Kingdom.
5. Buyer Responsibilities
Buyers must use the Website and communicate with Sellers honestly, lawfully, and in good faith. Buyers must not use the Website or contact Sellers for any scam, fraud, phishing attempt, money laundering, theft, deception, harassment, spam, or other criminal or unlawful activity.
Buyers are responsible for carrying out their own checks before entering into a Transaction. Such checks may include inspecting the motorcycle, verifying the Seller’s identity and authority to sell, checking the V5C, registration details, MOT history, service records, write-off status, outstanding finance, vehicle identification numbers, insurance position, roadworthiness, and any specialist build or modification documentation.
Buyers should not rely solely on a Listing or on any information hosted by the Website. We recommend that Buyers obtain an independent inspection, history check, or professional advice before paying a deposit, transferring funds, collecting a motorcycle, or riding it on a public road.
6. Genuine Contact Information and Account Use
All Buyers and Sellers must provide genuine, accurate, current, and non-misleading contact information when using the Website, creating an account, submitting a Listing, or contacting another User. Users must not impersonate another person, use false names, false addresses, disposable contact details for deceptive purposes, or contact details they are not authorised to use.
We may remove Listings, restrict messaging, suspend accounts, request verification, or refuse access to the Website where we reasonably believe that information is false, incomplete, misleading, unlawful, or associated with suspicious activity.
7. Listing Rules and Prohibited Content
Listings must be lawful, accurate, fair, and not misleading. A Listing must not include false pricing, hidden material defects, misleading photographs, copied content without permission, offensive material, unlawful goods, counterfeit documents, or any content that infringes intellectual property rights, privacy rights, or other rights of any person.
We may edit, reject, remove, suspend, or archive any Listing at our discretion where we reasonably believe it breaches these terms, creates risk to Users, may mislead Buyers, may expose us to legal or reputational risk, or may be unlawful.
8. Fees, Payments, Deposits, and Transactions
Any fees payable to us for advertising, premium placement, account features, or related services will be shown on the Website or agreed separately. Unless otherwise stated, our fees relate to use of the Website and do not make us a party to any Transaction between a Seller and a Buyer.
Buyers and Sellers are responsible for agreeing the price, payment method, deposit terms, collection or delivery arrangements, documentation, cancellation position, and any other Transaction terms directly between themselves. Users should take appropriate precautions when transferring funds or meeting in person.
9. Consumer Rights and Legal Compliance
Nothing in these terms limits or excludes any legal rights that cannot lawfully be limited or excluded, including consumer rights, statutory remedies, rights relating to faulty or misdescribed goods, rights arising from fraud or fraudulent misrepresentation, or liability for death or personal injury caused by negligence.
Sellers who act in the course of a trade, business, craft, or profession must comply with all applicable consumer protection, advertising, vehicle, safety, tax, trading standards, and distance selling laws. Private Sellers must also ensure that their descriptions are honest and that they do not misrepresent the motorcycle or conceal material information.
10. User Conduct and Fraud Prevention
Users must not use the Website to commit, assist, conceal, or facilitate fraud, theft, money laundering, identity misuse, phishing, payment diversion, harassment, threats, false reporting, unauthorised scraping, spam, malware distribution, or any other unlawful or harmful conduct.
We may monitor, moderate, block, report, or preserve communications and account information where reasonably necessary for safety, fraud prevention, compliance, dispute handling, enforcement of these terms, or cooperation with law enforcement or regulatory authorities.
11. Intellectual Property and User Content
Users retain ownership of content they upload, subject to any rights belonging to others. By submitting a Listing or other content, the User grants us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, adapt, promote, distribute, and use that content for the purpose of operating, marketing, improving, and protecting the Website and our services.
Users must not upload content unless they have the right to do so. This includes photographs, logos, written descriptions, inspection reports, build sheets, and any third-party material included in a Listing.
12. Availability of the Website
We aim to keep the Website available and functioning, but we do not guarantee uninterrupted, error-free, secure, or continuous access. We may suspend, withdraw, update, or change the Website at any time for maintenance, security, operational, legal, or commercial reasons.
13. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any loss arising from a Transaction, Listing, motorcycle condition, Seller statement, Buyer conduct, failed payment, missed sale, misdescription, mechanical defect, accident, injury, collection arrangement, delivery issue, or dispute between Users, except where such loss arises from our own breach of duty and liability cannot lawfully be excluded.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory rights where such liability cannot be excluded, or any other liability that cannot be excluded or limited under applicable law.
14. Suspension, Removal, and Termination
We may suspend or terminate a User’s account, remove a Listing, restrict access, or refuse future use of the Website if we reasonably believe that the User has breached these terms, provided false information, acted dishonestly, created safety or legal risk, misused the Website, or engaged in suspicious or unlawful conduct.
Where appropriate, we may cooperate with law enforcement, insurers, payment providers, regulators, Trading Standards, or other competent authorities.
15. Privacy and Data Protection
We process personal data in accordance with applicable UK data protection law, including the UK GDPR and the Data Protection Act 2018. Further information about how we collect, use, store, share, and protect personal data should be set out in our Privacy Policy and Cookie Policy.
Users must not misuse personal data obtained through the Website. Contact details supplied by another User must only be used for genuine enquiries or communications relating to a legitimate motorcycle Listing or Transaction.
16. Complaints and Disputes
If you have a complaint about the Website, please contact us using the details provided on the Website. If a complaint concerns a Transaction, Listing, motorcycle condition, payment, deposit, delivery, or Seller or Buyer conduct, we may encourage the relevant Users to resolve the matter directly, but we are not obliged to mediate or determine disputes between Users.
We may, at our discretion, take action where a complaint suggests a breach of these terms, suspected fraud, safety risk, unlawful conduct, or misuse of the Website.
17. Changes to These Terms
We may update these terms from time to time. The version published on the Website will apply from the date stated unless otherwise required by law. Continued use of the Website after changes are published indicates acceptance of the updated terms.
18. Governing Law and Jurisdiction
These terms and any dispute or claim arising out of or in connection with them, the Website, or its use are governed by the laws of England and Wales, unless mandatory law provides otherwise.
The courts of England and Wales will have jurisdiction, except that consumers resident in Scotland, Northern Ireland, or another jurisdiction may have the right to bring proceedings in their local courts where mandatory law allows.
